What is generally considered duty-free in the USA prior to new Directions (per Google AI)
- 1) Original artworks: Paintings, drawings, pastels, original engravings, prints, lithographs, and sculptures are typically exempt from import duty when they are original and hand-made.
- 2) Antiques: Works over 100 years old are also usually duty-free.
- 3) Works of archaeological, ethnographic, or historical interest: These are also covered under duty-free exemptions.
- NEW DIRECTION FROM WHITE HOUSE:
For goods shipped through the international postal system, packages will instead be assessed duties according to one of the following methodologies:
- - Ad valorem duty: A duty equal to the effective tariff rate imposed under the International Emergency Economic Powers Act (IEEPA) that is applicable to the country of origin of the product. This duty shall be assessed on the value of each package.
- - Specific duty: A duty ranging from $80 per item to $200 per item, depending on the effective IEEPA tariff rate applicable to the country of origin of the product. The specific duty methodology will be available for six months, after which all applicable shipments must comply with the ad valorem duty methodology.

In the U.S. government’s Harmonized Tariff Schedule, an artwork is defined by factors such as originality, artistic intent, and market perception. Broadly, this means that the object has to be either an original or a limited edition work. Its primary purpose should be for aesthetic appreciation, and it is recognized as fine art through its association with reputable galleries, auction houses, and so on. |
Artworks and other cultural objects may also be imported tariff-free, but currently exemption is legally unclear. Art lawyers, including some based in the US, have so far been unable to agree on the legal effect of the Order on US imports of art. |
